Real War on Women: single black mother faces jail for honest mistake

Liberal progressives love to rant about the so-called “War on Women” in order to advance an inane idea that the GOP hates women. Progressive socialists seem to feel the only thing important to women is abortion and having contraceptives. They fail to realize the priority for most women is finding better opportunities for their children by way of a quality education. But liberals only support choice when it comes to killing babies, not educating them.

But no doubt the most important concern for women, particularly in inner city communities, is providing for the safety of their children.

Paradoxically, predominately black neighborhoods may have the highest rates of crime and violence, but also the most restrictive gun laws.

Which leads me to the story of 27-year-old Shaneen Allen, a single black mother of two from Philadelphia who is being prosecuted in New Jersey for violating the Graves Act and faces three years in jail.

Last October, Ms. Allen was pulled over in New Jersey’s Atlantic County after making an unsafe lane change in the early morning hours. When she was stopped for the traffic violation, Allen told the officer that she had the .380 Bersa Thunder handgun, as well as a concealed carry permit for Pennsylvania, unaware that her permit was not transferable to The Garden State. But she was charged.

“The gun charge was not proper to begin with at all,” her attorney, Evan Nappen, told FoxNews.com. “She made an honest mistake.”

So to the liberal progressive gun control nuts I ask, is sending this mother to jail so vital for your agenda? Where are all those compassionate liberals who believe we should allow MS-13 gang members into our country but have no compassion for Shaneen Allen?

Funny, it seems that Ms. Allen and Marine Sergeant Andrew Tahmooressi have something in common — they both took a wrong turn by mistake and rightfully owned their guns — yet both are being persecuted.

Sergeant Tahmooressi, a decorated two-combat tour Marine, languishes in a Mexican jail and Ms. Allen, who has no criminal record, was later charged with unlawful possession of a weapon and possession of hollow-point bullets. If convicted, the illegal possession of the handgun is a second-degree felony punishable by a mandatory minimum sentence of three years in prison.

Now here is the insanity of Ms. Allen’s episode. “New Jersey’s draconian and crazy gun laws gives the judge no discretion here — none,” her attorney says. “You will get three years with no chance of parole if you’re convicted of this gun charge. So in the effort of promoting gun control in New Jersey, they’ve created a situation where very sympathetic people get harmed and turned into the victim by gun laws.”

Fox reports that “Allen had only owned the gun for a week prior to the arrest, according to her lawyer, and purchased it for her protection after being robbed twice in the past year. “The officer knew there was a gun there, she was completely honest and open,” Nappen continued. “There’s no aggravating factors in this case; she’s a single mom of two, working in the medical field who was robbed twice and that’s what inspired her to get a gun license in the first place.”

Despite a lack of a criminal record, Nappen said Allen was not accepted into a diversionary program that would allow her to avoid jail time altogether. Why? Can you liberal progressives explain this? It’s a true example of a “War on Women” — namely single black mothers seeking protection for their children. What message is sent? Be law abiding and make a simple mistake and you’re sentenced away for three years? And what of her children? Oh I get it, the welfare nanny-state will take care of it.

This is insanity, and where is New Jersey Governor Chris Christie on this case? America should be melting down his phone lines and demanding his state drop this insidious waste of taxpayer dollars and admit Ms. Allen into the diversionary program. Ms. Allen was scheduled for a pre-trial conference today — it should have never gone this far. What the episode surrounding Ms. Shaneen Allen demonstrates is that gun control agendas are more important than a hard working single black mother — a previous crime victim — protecting her children.

And where is President Obama who seems to chime in on every other situation? Governor Christie, where is your boisterous voice? Anyone who supports the prosecution of Shaneen Allen supports the real War on Women — inner city black mothers fighting against all odds.

The jury can decide to find her not guilty even if the State proves it’s case beyond a reasonable doubt. In essence the jury tells the Court your law is unjust and we are not going to punish the defendant for violating an unjust law.

However it should not matter. She should not be required to even have a permit! Being forced to have a permit is a limitation of her right to carry via the second amendment. She broke the law of New Jersey when she traveled across the Bridge leaving Pennsylvania and entering New Jersey. New Jersey and Pennsylvania have two different types of. PA It is a LICENSE TO CARRY and NJ is a Permit to Carry. Same would be said of a person with a Carry Permit caught in PA With a Registered Firearm and a Carry Permit, they would be arrested.

I am from Philadelphia.
PA Law on Firearms states that Open Carry is prohibited in Cites of the First Class (Philadelphia is First Class) therefore a License to Carry in PA is required in Philadelphia.

For the most part, many people do not open carry because of the unwanted attention from Anti Gun control people. So more prefer to carry concealed.

Also depended on Local Statue of each municipality they Prohibit Open carry. PA Gun laws also lets each municipality Police or Sheriff department restrict Open Carry.

So, try Open Carry in Philadelphia..See whats happens.

Each state has their own Permits/License, she had a gun legally purchased and registered in Pennsylvania. She does not have a New Jersey Permit to Carry Firearms. Laws are Laws. I have a Florida CWL. There are 34 States that recognizing the Florida License. It’s my responsibility to know which states I can bring my weapon into.

With that said it’s absurd that they would even waste the prosecutors time and the states money with this. I mean if you really want to punish her, write her a ticket for $500 and go about your day.

IN NJ, judges do not have discretion in firearm cases. The Graves Act made sentences mandatory. Once it goes to trial, the sentence is automatic on conviction. The prosecutor has discretion.

This is the legal way to transport THROUGH NJ according to Federal Firearm Owners Protection Act. There is no legal way to transport INTO NJ. If your destination is within NJ, you can not bring your gun here! If you stop at a rest area to pee, you may do jail time. She still would have been arrested in New Jersey once she parked her car in Atlantic City. There is no legal way to transport a gun into New Jersey unless you are going to a range or a gun shop. There are approx 6 million residents in New Jersey and approx 1 million gun owners yet there are less than 3,000 carry permits issued, how successful do you think a non-resident will be in getting a permit if less than .01% of the resident population can get one.

I have a book on the state laws on guns and it is an absolute nightmare between the states. If you go on a driving trip, your permit may be legal in one state, illegal in the next, questionable in the third, legal, illegal…and that’s only five states..It’s not easy to get a permit, you must be fingerprinted and a background check by the FBI and your local PD, you cannot get a permit if you are a felon, a spouse abuser, drug user, etc. If the state has to do something, why not treat it like a traffic ticket?… Read more »

P.S. Anyone who has a Philadelphia CC permit would know not to enter NJ and if you do to use your right to remain silent and force the police to do an illegal search for something they do not know is there.

Her trial begins October 6th. There is a campaign within NJ to try to convince the prosecutor to allow pre-trial intervention instead of the mandatory 3 years in prison. First offenders always get PTI but the prosecutor wants to make an example of this woman because she’s gotten news coverage. Only the prosecutor can stop this since NJ law makes sentences mandatory – no judicial discretion. Angry NJ residents have been calling the Atlantic County prosecutor John McLain at (609) 909-7800 New Jersey Attorney General John Hoffman at (609) 292-8740 and Governor Chris Christie at 609-292-6000. because people have made it an issue. The harshest gun control laws come from inner cities which are populated mostly with minorities. It’s a joke really because the only people following the law are law abiding citizens. Criminals are already breaking the laws. Who could really believe they are going to follow THAT one? I agree with just about everything that Col West comments on, except this. I believe in the 2nd amendment and I, myself have a Connecticut State Permit. But I KNOW THAT I CANNOT CROSS THE STATE LINE INTO NEW YORK, MASSACHUSETTS OR RHODE ISLAND WITH MY GUN IN MY CAR . Gun laws are not reciprocal in other states.

One way to get a bad law changed is to actually enforce it. Perhaps the prosecutor does recognize the injustice of the law, particularly as it applies to Shaneen, and is enforcing the law to the fullest in order to get the law changed. Which means that Shaneen is just a pawn in a much bigger game. Either that or the prosecutor is a serious A-hole. Good luck to Shaneen. The people are on her side.
